Guess what time it is?
That's right, it's "HTC continues to violate the GPL" time!

No source for HTC EVO Shift 4G yet ('Speedy'). I mailed, asking:
Hello. I require support code for kernel version on my EVO Shift 4G, according to the GNU General Public License. Please send it immediately. Thanks, joshua

Philip responded:
I understand that you are looking for the source code for your EVO Shift. HTC will typically publish on http://developer.htc.com the Kernel open source code for recently released devices as soon as possible. HTC will normally publish this within 90 to 120 days. This time frame is within the requirements of the open source community. Please continue to check developer.htc.com for the code to be posted. If you should need anything else, please feel free to contact us again.

To which I've thus far responded:
That's not true; that time frame is not within the requirements of the open source community. We had this discussion with the HTC EVO 4G (see ticket 10USCW53ENA000438), which ended in HTC releasing the source. Let's save both of us the breath this time.

Thank you for your response. I certainly have no problem with us not wasting breath about it. As you point out, you've already been through this discussion with us before and you know the result: the code will be posted when it's posted. No amount of arguing with HTC Technical Support has any effect on when the source code is actually posted. When the team responsible for posting the code puts it up, it will be there. Further than that, the discussion would go the same as previously.

I responded this evening with:
I'm sorry, but last time we had this conversation, the result was source being released. The source *does* exist somewhere there, and all HTC needs to do is tar it up and upload it. In fact, legally, HTC is not allowed to make any modifications to "prepare" it, so it should be even simpler! Like we determined last time, the terms under which you distribute the binaries indicate that you *must* provide source immediately. As such, I will be happy to receive source within the next 24 hours. Thanks!

and again they responded:
Thank you for your reply about getting the source code for your EVO 4G Shift device. We have no control over when this is posted to the website. Once the department that is responsible for posting the code gets everything ready to be posted then it will be posted to the website. You will just want to keep an eye on our developers website to see when the source code is posted to the website.

We'll see what happens. I'm getting sick of this.

e: Overnight, source was released. It would be nice if I didn't have to go through this each time.

weird, usually I see "8" in someone's post and momentarily think that it's me, but it usually isn't. This is the first time I saw "Philip" in someone's post and thought it is me, but it wasn't.
